Abortion Laws: Restrictions + Protections

In 2024, Montana voters amended the state constitution to expressly provide a right to abortion and prohibit government from denying the right to abortion prior to fetal viability.

Post-viability abortion restriction: No abortion may be provided after viability unless necessary to preserve the woman’s life or health. Mont. Code Ann. § 50-20-109 (Enacted 1974; Last Amended 2005)
→  Provision requiring the certification by two physicians, in addition to the attending physician. Doe v. Deschamps, 461 F. Supp. 682 (D. Mont. 1976).

Section 1115 Family-Planning waiver

  • Allows the state to cover family-planning services for women between the ages of 19 and 44 with incomes at or below 211% of the federal poverty level who are not otherwise eligible for Medicaid or do not have other family-planning coverage
    • Limited to 4,000 participants at a time
    • Enrollees must be (1) U.S. citizens or persons who meet the state’s defined immigration requirements and (2) Montana residents
