Abortion Laws: Restrictions + Protections

Despite Roe v Wade being overturned, access to abortion is protected in Montana’s state constitution.  However, Montana’s republican governor has asked the state supreme court to overturn that protection.

For the first time in nearly a decade, new abortion restrictions were enacted in 2021, including restrictions on medication abortion and abortion at 20 weeks of pregnancy. MT requires parental notification for minors 16 years of age or younger, but there is no requirement for parental consent. Montana does not require one to attend a counseling session or go through a waiting period before getting an abortion.

Insurance Coverage

Does Montana law allow insurance to cover abortion? Usually, Yes!

Section 1115 Family-Planning waiver

  • Allows the state to cover family-planning services for women between the ages of 19 and 44 with incomes at or below 216% of the federal poverty level who are not otherwise eligible for Medicaid or do not have other family-planning coverage
    • Limited to 4,000 participants at a time
