Abortion Laws: Restrictions + Protections
In 2024, Montana voters amended the state constitution to expressly provide a right to abortion and prohibit government from denying the right to abortion prior to fetal viability.

Insurance Coverage
Does Montana law allow insurance to cover abortion? Yes!

Section 1115 Family-Planning waiver
- Allows the state to cover family-planning services for women between the ages of 19 and 44 with incomes at or below 211% of the federal poverty level who are not otherwise eligible for Medicaid or do not have other family-planning coverage
- Limited to 4,000 participants at a time
- Enrollees must be (1) U.S. citizens or persons who meet the state’s defined immigration requirements and (2) Montana residents
- Covered services include: contraceptive counseling and information; contraceptive supplies, devices, implants and prescriptions; office visits, consultation, examination and medical treatment provided in conjunction with family-planning services; voluntary sterilization; diagnosis, testing and treatment of STIs found during a family-planning visit; pap tests and family-planning-related laboratory testing.
